Portland Public Schools back down after banning mom who challenged gender identity policies

Portland Public Schools agreed to “sweeping concessions” in settling a lawsuit by a mother whom it claimed violated the district’s hate speech harassment policy by engaging in sidewalk advocacy against its gender identity curriculum, according to her lawyers. The Oregon school district banned Allison Roberts in February from visiting her children’s school, which meant she missed her son’s graduation from Meriwether Lewis Elementary School. Her daughter still attends the school.
Roberts was protesting “the introduction of ‘trans’ ideology” into her children’s school and wanted to raise her children in her faith as a liberal Christian. The elementary school first alarmed Roberts in the 2025-26 school year, when it replaced the gay “pride flag” motif on school benches with the “clearly political” Progress Pride flag.
Liberty Justice Center, which represented Roberts in a lawsuit challenging the ban in August, said Tuesday that the school district has agreed to reverse several of the actions challenged in the case.
The school district has agreed to lift the ban and trespass notice, withdraw its warning that Roberts violated school policies and instead recognize her First Amendment right to peacefully distribute literature on a public sidewalk and criticize school officials and policies, and exempt her children from the school’s LGBTQ2SIA+ curriculum and learning activities for the 2026-27 school year.
“Portland Public Schools tried to silence a mother who dared to question what was happening in her children’s school. Now the district has agreed to withdraw its warning, rescind its campus ban, and recognize her right to speak freely,” Timothy Snowball, lead attorney for the Liberty Justice Center’s PARENTS Initiative, said in a statement. “This is a major victory, not just for Allison Roberts, but for every parent who has been told to stay quiet and leave these decisions to school officials.
“But the fight is not over,” he continued. “The district continues to defend policies that allow school officials, under certain circumstances, to withhold important information from parents about their own children. Parents have the fundamental right to direct their children’s upbringing and education. We intend to keep fighting until those rights are protected.”
The concessions come just days before a scheduled hearing in Roberts’ motion for a preliminary injunction.
The Liberty Justice Center represented Roberts under its new PARENTS Initiative – Parental Action and Rights Enforcement to ensure Notice, Transparency and Safety.
