An Obama-appointed federal judge halted President Trump’s executive order aimed at preventing noncitizens from registering to vote or casting ballots in federal elections, ruling that the president lacks the constitutional authority to set election rules. The decision marked the second time in two days that a federal court struck down a Trump election integrity order, a pattern that has sharpened the White House’s demand for Congress to pass the SAVE America Act.
U.S. District Judge Indira Talwani, who has served on the U.S. District Court for the District of Massachusetts since 2014, granted summary judgment against provisions of Executive Order 14248. The order had directed the creation of a federal voter registration list, imposed new restrictions on mail-in ballot eligibility, and instructed the U.S. Postal Service to deliver mail-in ballots only to individuals on that list.
