A federal judge on Monday dismissed most of Minnesota’s challenge to President Donald Trump’s executive order declaring the existence of only two sexes. While the Trump administration has worked to enforce its trans policies, particularly its efforts to keep biological men out of women’s sports, it has yet to issue any determination on Minnesota’s compliance, a point on which the judge focused.
Minnesota District Chief Judge Eric Tostrud noted that “Minnesota will not face legal consequences unless and until a hearing is held in which the relevant agency finds that Minnesota is not in compliance with Title IX, or a court finds, in a civil enforcement action, that Minnesota is not in compliance with Title IX.”
“Neither event has occurred here. The Findings themselves impose no legal injury on Minnesota,” he added, according to Politico.
Minnesota has argued that the administration violated the Administrative Procedure Act, though Tostrud found that it failed to prove that point.
