U.S. District Judge Denise Casper on Wednesday permanently struck down the core of President Donald Trump’s executive order on elections, ruling that the president lacks constitutional authority to require documentary proof of citizenship for voter registration. The decision landed the same day Trump traveled to Capitol Hill to press Senate Republicans on the SAVE America Act, legislation that would accomplish through Congress what the courts have now told him he cannot do alone.
Casper, an appointee of former President Barack Obama, converted a preliminary injunction into a permanent ban on most provisions of the March 2025 executive order titled “Preserving and Protecting the Integrity of American Elections.” The order had sought to require documents such as a passport, birth certificate, or naturalization papers before a person could register to vote in federal elections. It also would have blocked states from counting mail-in ballots received after Election Day, even those postmarked on time, and threatened to withhold federal election funding from states that refused to comply.
