A federal judge handed the Trump administration a major legal victory by refusing to block 62 miles of border wall construction on a Native American reservation in Arizona, ruling that border security outweighs the tribe’s claims of irreparable harm.
U.S. District Judge Richard Leon denied the Tohono O’odham Nation’s motion for a preliminary injunction on Friday, rejecting the tribe’s argument that the planned wall would illegally trespass on its 2.8-million-acre reservation in the Sonoran Desert. Leon, a George W. Bush appointee sitting in Washington, D.C., found that the tribe had not established that building a border wall would change its reservation boundaries without congressional authority.
