(CN) — A Fifth Circuit panel grilled the Food and Drug Administration on Tuesday on whether it went through a proper notification process before instituting a marketing requirement that vape manufacturers prove flavored vapes are more effective at helping smokers quit better than plain tobacco-flavored vapes.
