Trump seeks to be reimbursed for legal expenses in Fani Willis case, based on recent Georgia law

President Donald Trump is seeking to have a Georgia judge award him over $6 million in attorney fees that he incurred while defending against the criminal prosecution he faced from the indictment brought by Fulton County District Attorney Fani Willis. Trump was indicted in a case alleging that he headed up an unlawful conspiracy to overturn the 2020 election results in Georgia.
He is basing his case for being paid back the $6.26 million in attorney fees and related costs for his defense on a Georgia law passed in 2025 that allows criminal defendants to recover their legal expenses if the prosecutor in the case is removed for improper conduct, according to The Hill.
Willis was disqualified over an “appearance of impropriety” based on her romance with Nathan Wade, who she had hired to prosecute Trump. The case finally reached its conclusion last November when a special prosecutor who had taken over the case decided not to go forward with the charges.
The demand for the reimbursement goes to Judge Scott McAfee, who oversees the case. The state law requires him to approve it if the amount is considered “reasonable.”
“In accordance with Georgia law, President Trump has moved the Court to award reasonable attorney fees and costs incurred in his defense of the politically motivated, and now rightfully dismissed, case brought by disqualified DA Fani Willis,” said Trump’s lead attorney in the case, Steve Sadow.
