A federal judge on Thursday dismissed the Trump administration’s lawsuit against California over egg production regulations, finding the administration lacked standing to bring the suit.The Trump administration brought the lawsuit last year as part of an effort to lower egg prices, which spiked in 2024 and became a symbol of rising cost-of-living issues.
U.S. District Judge Marc C. Scarsi found the government had been unable to show it had a stake in the case, arguing “[b]ecause the United States ‘is not the target of the challenged government action,’ as it does not allege it is a participant in the egg marketplace to which the subject California laws and regulations apply, the federal government’s ability to bring suit is ‘substantially more difficult to establish.’”
“And unlike with the chickens and eggs at issue here, there is no question that an analysis of standing must come first,” the judge quipped, referring to the longstanding rhetorical question on whether the egg preceded the chicken or vice-versa.
