On Tuesday, December 9, the City Commission of Amherst, Texas (pop. 671) became the 89th city in the nation, and the 72nd city in the State of Texas, to pass a Sanctuary City for the Unborn Ordinance. The “Ordinance Outlawing Abortion, declaring Amherst a Sanctuary City for the Unborn” passed in a unanimous 2-0 vote. The City of Amherst, located between the cities of Sudan (pop. 958) and Littlefield (pop. 5,871), is the third city in Lamb County to consider and adopt a Sanctuary for the Unborn Ordinance, following the City of Olton (pop. 2,228) and Sudan (pop. 958).
The Amherst Sanctuary City for the Unborn Ordinance, which is enforced through a private right of action – just like the Texas Heartbeat Act, (1) prohibits performing an elective abortion and aiding or abetting elective abortions within the city limits of Amherst, (2) prohibits elective abortions on residents of Amherst – regardless of where the abortion takes place, (3) prohibits abortion trafficking through the City of Amherst, (4) prohibits the mailing of abortion-inducing drugs into the City of Amherst, (5) prohibits criminal organizations from doing business inside the city limits of Amherst, and (6) prohibits through or in the City of Amherst the transportation and disposal of the remains of unborn children who have been killed by an elective abortion across state lines and carried into Texas by waste management companies.
