Watchdog to file supplemental bar complaint against Jack Smith

The Center to Advance Security in America (CASA) will file a supplemental bar complaint against former special counsel Jack Smith after previously lodging one in October. The conservative nonprofit originally asked the New York Supreme Court to open an investigation into Smith’s potential violation of state rules. Now, CASA plans to file a supplemental complaint with the New York Appellate Division for alleged violations of professional conduct rules.
“As new information has come to light regarding Jack Smith’s flagrant violation of a federal district court order in United States v. Trump, CASA has filed a supplemental bar complaint and is hopeful for an immediate investigation by the New York Bar,” CASA Director James Fitzpatrick said. “The district court wrote that Smith’s refusal to follow this order was ‘brazen’ and without legal authority. We agree. Smith’s nakedly political attempt to prosecute President Trump and his allies knew no bounds. He needs to be investigated for this type of egregious violation.”
Specifically, CASA argues that Smith disregarded court orders by continuing his operations after a court ruled he was illegally appointed and planning to release his report despite an order barring such action. Judge Aileen Cannon, in February, issued the order barring the release of the second half of Smith’s report, saying “[t]here is the matter of manifest injustice to the former defendants that would result from disclosure of Volume II.”
“Special Counsel Smith, acting without lawful authority, obtained an indictment in this action and initiated proceedings that resulted in a final order of dismissal of all charges,” she added. “As a result, the former defendants in this case, like any other defendant in this situation, still enjoy the presumption of innocence held sacrosanct in our constitutional order.”
Cannon was also the judge who found Smith was illegally appointed. Attorney General Merrick Garland tapped Smith for the post in late 2022, after then-former President Donald Trump announced his 2024 campaign.
