The Justice Department charged a man Monday who was shot by a Border Patrol agent in Portland, Oregon, last week, with aggravated assault of a federal officer with a deadly or dangerous weapon. The department alleged that the man, identified as Luis Nino-Moncada, was an illegal migrant who was a known associate of the Venezuelan gang Tren de Aragua. He was ordered to be removed from the United States in 2024.
The department also alleged the man repeatedly struck a federal law enforcement vehicle during the altercation last week, resulting in damage to federal property, after he was ordered to leave his vehicle during a targeted immigration enforcement operation.
“Anyone who crosses the red line of assaulting law enforcement will be met with the full force of this Justice Department,” Attorney General Pam Bondi said in a statement. “This man — an illegal alien with ties to a foreign terrorist organization — should NEVER have been in our country to begin with, and we will ensure he NEVER walks free in America again.”
The altercation resulted in a shooting last week involving a Border Patrol agent who the Department of Homeland Security claimed feared for his “life and safety,” and fired a “defensive shot.” The passenger of the vehicle, also believed to be tied to Tren de Aragua, was also injured in the shooting.
The incident occurred a day after an Immigration and Customs Enforcement officer fatally shot a woman in Minneapolis who was allegedly attempting to run agents over with her car.
Nino-Moncada is scheduled to make his initial court appearance in Oregon on Monday afternoon.
