Democratic congressional leaders announced Wednesday that they are suing the Trump administration over allegations that it is attempting to unlawfully remove suspected noncitizens from state voter rolls and intimidate election officials.Senate Minority Leader Chuck Schumer and House Minority Leader Hakeem Jeffries filed the lawsuit in a federal court in Washington, D.C., accusing the administration of attempting to undermine trust in the midterm elections next month.
“[President] Trump knows he can’t win a fair fight, so he’s resorted to bullying election officials into stripping Americans of their right to vote,” Schumer posted on X. “It’s illegal, it’s un-American, & we’re taking him to court to stop it. The voters decide who wins elections. Not Trump.”
The lawsuit alleges that the Department of Homeland Security has pushed states to review unreliable lists of suspected noncitizens, while federal officials have threatened state and local election officials to ensure compliance.
The complaint stated President Donald Trump himself had threatened last week to imprison California election officials if they counted mail-in ballots by people the administration believed were noncitizens.
“None of this is lawful,” the complaint reads. “The Executive Branch enjoys no authority to superintend state voter list maintenance, to supplant state determinations of who is qualified to vote or to dictate who gets a ballot or whose ballot gets segregated.”
The Justice Department rejected the arguments, stating that everything it has done to protect American elections has been within the bounds of the law.
“Ensuring that only eligible citizens vote and that every lawful ballot is counted a requirement of federal law,” Justice Department spokeswoman Kiersten Pels told the Washington Post.
